TERMS AND CONDITIONS relating to CAR PARKING, RESERVATIONS AND ROOM OCCUPANCY (“Guest Terms”)

General business conditions

1. PARTIES

1.1           These Guest Terms shall be made between: 

(a)        Begić d.o.o.  registered in Croatia with company number HR34354010338 whose registered office is at Poljička cesta – Duće Rogač – 3; HR- 21310 Omiš (“Pansion Begic”) which company acts as booking entity by which your reservation is made;

(b)        The hotel in which the Guest stays, visits or uses hotel facilities, details of such entity being available from our website, front desk, guest registration card or hotel generally (“the Hotel”). The Hotel is registered in Croatia with company number HR34354010338 whose registered office is at Poljička cesta – Duće Rogač – 3; HR- 21310 Omiš and

(c)        the individual or corporate party booking the reservation and/or completing the registration card (“Guest”). 

1.2           The Guest shall act as agent for other guests (if any) in the party (“Group”) and by booking with the Hotel and completing and signing the guest registration card. The Guest confirms he/she has authority from the Group to act on its behalf and in so doing individual members of the Group contract with Pansion Begić on these terms. 

1.3           The reservation shall be subject to the Guest Terms and any additional booking terms which have been notified to the Guest at the time of booking (“Booking Terms”).  In case of conflict, these Guest Terms prevail over any Booking Terms save for any expressly amended, authorised and agreed cancellation rights and payment terms including but not limited to wholesale contracts, meeting and event contracts, corporate rates and online travel agency agreements.  No change to these Guest Terms is permitted without the express written consent of Begić d.o.o..

2.             RESERVATIONS

2.1           Guest may check in from 15:00 to 21:00 on the day of arrival.  Check out time is 7:00 – 10:00 am. 

2.2           Reservations cannot be applied to alternative dates, nor extended or reduced without prior agreement with Begić d.o.o..  Room types and facilities are specified in the Booking Terms. 

2.3           Guest reservations will be retained by Begić d.o.o. until 9pm on the arrival date and may be cancelled thereafter by Begić d.o.o. without further liability on Begić d.o.o.’s part unless Begić d.o.o. has agreed otherwise in writing or where Begić d.o.o. has received advanced payment of the full amount chargeable for the reservation.

2.4           Begić d.o.o. reserves the right, at its sole discretion, to release any reservation at any time without charge, penalty, loss or damage if it believes that the guest is unfit to stay in the Hotel. Unfit can mean being drunk, disorderly, abusive, aggressive or impolite or causing a danger to other guests, Hotel employees and contractors.

2.5           If Begić d.o.o. fails to have a room available for a Guest whose reservation has not been cancelled or released in accordance with these Guest Terms, Begić d.o.o. will provide a room in another hotel of similar standard on the same terms and conditions for the first night of the reservation. Begić d.o.o. will (i) provide a taxi from the Hotel to the replacement hotel and, where applicable, a taxi for the return journey; and (ii) provide the Guest the facilities to make a telephone call to explain the new arrangements. 

2.6           Reservations are personal to the Guest and cannot be resold or transferred without the express written permission of Begić d.o.o..   

2.7           For reservations of over 5 rooms (“Group Booking”), please telephone the Hotel directly in order to make a Group Booking.   

3.             CANCELLATIONS

3.1           Reservations may be cancelled by the Guest up to 7 days before  arrival without charge, later cancellations will be charged with the price of the first night. The cancellation price is always the standart room price and does not contain any special offers or dicounts.

3.2           Cancellations are valid where made by the Guest in writing or by phone call to the Hotel and must contain the details of the reservation that needs to be cancelled including Guest’s name, address and any reservation number.  

3.3           A reservation which has not been cancelled by the Guest in accordance with these Guest Terms and where a Guest does not show up will be cancelled by Begić d.o.o. for any subsequent days and a charge made equal to the value of the whole reservation amount.

3.4           Begić d.o.o.  reserves the right to cancel the reservation at any time where:

(a)        the Guest’s use of the Hotel may, in the reasonable opinion of Begić d.o.o., be prejudicial to the reputation of Begić d.o.o.  or 

(b)        in the reasonable opinion of Begić d.o.o., a reservation was made fraudulently or in violation of these Guest Terms or any other terms applicable to Guest’s reservation. 

Any refund payable in such circumstances is at the sole discretion of Begić d.o.o.  and is subject to any claim for damages under clause 9.7.  In order to minimise the risk of cancellation under this clause, Guests are advised to discuss any contentious or controversial purposes of their reservation with Begić d.o.o. prior to booking. 

3.5 Non-Refundable Reservations and Modifications

(a) Waiver of Exceptions: The non-refundable and non-changeable terms apply universally, and exceptions will not be made for personal schedule changes, travel disruptions, or force majeure events, unless otherwise required by applicable local consumer protection laws.

(b) Non-Refundable Policy: For any reservation explicitly designated as “NON-REFUNDABLE”, Begić d.o.o. is under no obligation to issue a refund under any circumstances, regardless of when the cancellation request is made.

(c) No Date Changes: Reservations marked as non-refundable are strictly fixed. Begić d.o.o. is not obligated to permit, accommodate, or process any requests for date changes, rescheduling, or booking modifications.

4.             CHARGES

4.1          Begić d.o.o. will charge the Guest the tariff specified in the Booking Terms. Breakfast is only included where specified in the Booking Terms, all other meals and room service are not included. 

4.2           Payment is required in advance or upon check-in for the estimated charges for the number of room nights and number of breakfasts.  Begić d.o.o. reserves the right to refuse entry to the Guest until such pre-payment is received. Should the pre-payment exceed the total charges, Begić d.o.o. will refund the balance to the Guest on departure, using the a adequate  payment method.

4.3           Begić d.o.o. reserves the right to demand payment of amounts accruing to a Guest’s account at any time and to preclude the Guest from continuing to occupy the Hotel should this demand not be met.

4.4           Should the Guest fail to pay his/her account on demand, Begić d.o.o. reserves the right to remove the Guest’s property from the Hotel and to store the same until the account has been paid; for which Begić d.o.o. may charge the Guest reasonable storage and administrative costs. Begić d.o.o.  has a lien on the Guest’s property which it may sell to pay the account and shall refund the balance, if any, to the Guest. The Guest shall indemnify Begić d.o.o. for any losses suffered by way of a Guest failing to pay their account.  Any continued reservation is contingent upon the Guest’s pre-payment in cleared funds.

4.5           Begić d.o.o. may at its discretion use accredited travel agents for specific services and invoice the travel agent concerned for these services.  Begić d.o.o. reserves the right to refuse to accept any vouchers from travel agents at its sole discretion. Begić d.o.o. will not disclose any rates that have been agreed with travel agents for the services provided. Travel agents may not disclose the confidential rates agreed with Begić d.o.o..

4.6           Begić d.o.o.  may, at its sole discretion, agree to grant credit to a Guest during their stay and reserves the right to demand payment at any time from the Guest for any balance accruing.  Payment of credit accounts must be made within 14 days of departure of the Guest or such other shorter period that has been notified to the Guest in advance. Should there be a dispute as to the account, the non-disputed amount shall be paid immediately and as soon as the dispute has been resolved, the disputed amount shall be paid forthwith.

5.             CONDITIONS ON WHICH A GUEST MAY OCCUPY A ROOM

5.1           Subject to these Guest Terms, the Guests shall occupy the room as bare licensee only and no relationship of landlord and tenant shall be created by the Guest’s use of the room. The Hotel retains control, possession and management of the room and the Guest agrees that s/he shall not have exclusive possession of any room. The Hotel may in its absolute discretion move the Guest and/or allow Hotel employees access to service, repair, tidy and clean the room daily or from time to time.

5.2           It is a condition precedent that the Guest may only occupy the room following check-in where s/he has: (i) completed and signed the guest registration card; (ii) provided identification; and (iii) provided advanced payment.  Only those Guests to whom a room is allocated may occupy the room.  Guests are not permitted to resell or transfer their booking.  Begić d.o.o.  and the Hotel will use reasonable endeavours to ensure a room is available for occupation by the Guest at the stated check in time. 

5.3           During occupancy of the room and whilst on Hotel premises the Guests will not:

(a)           make excessive noise;

(b)           damage or remove Hotel property, whether in the room or on any part of the premises. Any damage or removal will be paid for by the Guest and amounts to be paid shall at the sole discretion of the Hotel;

(c)            leave the room in a disorderly state or such state as will cause distress to the cleaners;

(d)           use any electrical appliance, other than those supplied or approved by the Hotel, in particular electric water heaters, cooking devices, any equipment greater than 3 kWh or, where stated,  greater than the kilowatts stated on any particular socket;

(e)           smoke in any room or on Hotel premises except in designated smoking areas;

(f)            park a car or other vehicle otherwise than as agreed by the Hotel or cause obstruction around the Hotel;

(g)           bring or allow into the room any person other those allocated to the room, particularly after 9pm, and will cooperate with the Hotel in having such persons removed;

(h)           enter or occupy any room which has not been allocated to them or obstruct any common parts of the Hotel;

(i)             interfere with other guests, their property or their enjoyment and peaceful stay at the Hotel;

(j)             bring into the Hotel any animal or pet;

(k)            do or permit anything which is illegal or which may become a nuisance including the infringement of any third party intellectual property rights in particular whilst using the Hotel’s internet connection;

(l)             comply with health and safety and fire regulations displayed in the Hotel.

5.4           During the stay the Guest will produce identification, by way of the room card issued at the time of registration, as evidence of Guest’s occupancy at the Hotel should it be required in the Hotel restaurants, other sales areas and at any time on the Hotel’s premises in the interests of safety and security. 

5.5           Upon check-out the Guest will notify the Hotel reception desk of departure and pay all outstanding charges that are due.

6.             CAR PARKING TERMS (where applicable)

6.1           Subject to this clause and upon request by the Guest, the Hotel permits the Guest to use such car park space as the Hotel may in its sole discretion allot to the Guest (“Space”) for the duration of the Guest’s stay or visit to the Hotel.  The Guest may only occupy the Space once the required details have been completed on the guest registration card and a space is available.   

6.2           The Guest acknowledges that occupation of the Space by the Guest is as a bare licensee only and no relationship of landlord and tenant shall be created by the Guest’s use of the Space. The Guest also agrees that s/he shall not have exclusive possession of any Space.  The Hotel may in its absolute discretion request the car is moved by the Guest for example in order to perform repairs and clean the Space. 

6.3           Cars are parked at the Guest’s own risk and the Hotel cannot guarantee the security of your car or its contents.  Guests are advised to ensure cars are locked securely, that all windows are securely closed and possessions left out of sight and that the car’s alarm is engaged.  Please contact the Hotel prior to booking to determine any height, or other, restrictions. 

6.4           Charges and disposal of vehicles:

(a)        Payment is required immediately prior to check-out of the Space by the Guest.  The Hotel reserves the right to refuse to permit the Guest to occupy the Space until prepayment is received.  Begić d.o.o. and the Hotel reserve the right to demand payment of amounts accruing to a Guest’s account at any time and to preclude the Guest from continuing to occupy the Space should this demand not be met. 

(b)        Should the Guest fail to pay his/her account on demand, the Hotel reserves the right procure removal of the Guest’s car from the car park by a lawful authority for which Begić d.o.o.  may charge the Guest reasonable removal and administrative costs.  .  Cars parked otherwise than in a designated space may be towed away by a lawful authority without notice.  Guests will be charged for recovery.

(c)        The Guest must notify the Hotel in writing if s/he intends to leave his/her vehicle in the car park for more than 28 days.  The Hotel reserves the right to procure removal of any car by a lawful authority which the Hotel reasonably believes to have been abandoned and shall be entitled to regard as abandoned any car which has been in the car park for more than 28 days without prior notification. 

6.6           The Guest shall:

(a)           drive carefully in the Hotel car park and not obstruct entrances or exits and shall obey signs, including parking in bays to which entitled;

(b)           not make any alteration to the space nor cause any damage to the Hotel or to any property of the hotel owners.  Any damage caused shall be immediately reported to the Hotel and damages caused to another vehicle should be reported by the Guest to the owner of the vehicle or the reception;

(c)           ensure his/her car is registered with valid insurency and is roadworthy and complies with all relevant laws;

(d)           not display any advertisement, or notices at the space and not conduct any business activity in the car park for example in connection with selling, hiring or other disposal of vehicles or goods or services;

(e)           not cause any nuisance or inconvenience, deposit rubbish other than in proper receptacles nor pour or transfer fuels within the car park; and

(f)            ensure that all security barriers or gates at the entrances to and exits from the car park are operated correctly and closed after use and/or to return to the Hotel any keys or control cards to any security barriers or gates to the car park when this licence ends. 

(g)           agree that for safety reasons no-one is entitled to remain in the car park except for the purposes of parking or removing cars. 

7.             TERMINATION

7.1           This Agreement and any licences granted within shall end on the earlier of:

(a)        the date and time upon which the Guest checks out of the Hotel, finishes the use of the allotted car parking or otherwise the Hotel services ordinarily cease and

(b)        Begić d.o.o.  and/or the Hotel giving notice of termination with immediate effect if the Guest breaches any of the Guest Terms.

7.2           Termination is without prejudice to the rights of either party in connection with any prior breach of these Guest Terms. 

8.             LIMITATION OF LIABILITY and DISCLAIMERS

8.1           Guests are advised to be adequately insured, to be vigilant and to take reasonable care over their property generally and especially in spaces accessible to the public as Begić d.o.o.  and the Hotel are not responsible for theft, loss or damage caused by third parties outside their control.

8.2           For Guests booking Hotel sleeping accommodation:

While the Hotel will make all reasonable efforts to protect the property of the Guests, attention is drawn to the Hotel Rules (Act), a copy of which is displayed in the Hotel and to the provisions of this clause. In the event of loss, theft, or damage to property that has been properly handed over with a receipt, the Hotel’s maximum liability is strictly limited to a total of 200,00 € per guest (aged 18 and older). The Hotel assumes no liability whatsoever for any money, valuables, luggage, or personal belongings that are kept in guest rooms, public areas, or left unattended. Furthermore, this liability does not apply under any circumstances to cars, vehicles, or any belongings left inside vehicles parked on or near the Hotel premises. 

8.3           For all Guests:

Subject to the provisions of the Act (where applicable), the Hotel’s and Begić d.o.o.’s liability to the Guest whether in contract, tort (including negligence) or otherwise arising in connection with this Agreement shall be limited to 50,00 € per item and an aggregate of 250,00 €  per guest, such amount the Guest agreeing is fair and reasonable given the value of the booking and the Guest’s ability to procure travel or other insurance.

8.4           In no event shall the Hotel and Begić d.o.o.  be liable for any loss of profit, revenue, anticipated saving, business opportunity, goodwill, corruption of data, damage resulting from third party claims or indirect or consequential losses. The Guest agrees the booking charges reflect that the risk of such loss lies with the Guest which is fair, reasonable and proportionate given the charges billed.

8.5           For the avoidance of doubt, the Hotel and/or Begić d.o.o.  do not accept any liability for theft, loss or damage caused to any vehicle or its contents whilst parked on any Hotel property and as such any vehicles and contents are left entirely at the Guest’s risk. 

8.6           Food served at the Hotel is prepared in a restaurant and not a factory setting. Whilst every attempt is made to ensure that Guests are fully informed as to the ingredients that dishes contain, the Hotel and Begić d.o.o.  are unable to guarantee that food will be free from specific allergens and as such any food served by the Hotel is consumed at the Guest’s own risk.

8.7           A 250,00 € fee shall be charged for smoking in guest rooms as this is not permitted, except for designated smoking rooms. 

8.8           The Guest shall keep the Hotel and/or Begić d.o.o.  indemnified in full against all direct, indirect or consequential liabilities, loss, damages, injury, costs and expenses awarded against or incurred or paid by the Hotel and/or Begić d.o.o.  as a result of or in connection with:

(a)        the Guest’s breach of the Guest Terms;

(b)        any infringement or alleged infringement of any intellectual property rights by the Guest during the stay at the Hotel;

(c)        any damage caused to the Hotel premises (or contents) whether or not owned by the Hotel, caused by the Guest.

8.9           Nothing in these Guest Terms shall limit or exclude the liability of the Hotel and/or Begić d.o.o.  for (a)  death or personal injury resulting from negligence, or (b) fraud or fraudulent misrepresentation.

9.             DATA PROTECTION

9.1           The information provided to Begić d.o.o.  by the Guest during booking and on the registration card will be handled by the Hotel as data controller in accordance with applicable data protection requirements.  The information may be used by the Hotel within and outside of the country or jurisdiction in which the Hotel is located (including to countries outside the EU), for purposes of managing and fulfilling your booking and for other business-related purposes permitted and/or required under applicable law.  Where data is transferred outside of the EEA, Begić d.o.o.  will not be responsible for data security and will not ensure appropriate technical and organisational measures are in place. 

9.2           Except as set out above, the Hotel will not use Guest information given for any other purpose unless the Guest agrees or unless the Hotel is required or permitted to do so by law.  By agreeing to the Guest Terms and completing this registration card you are signifying your consent (and that of your Group) to your personal data being processed in accordance with the above statement. 

10.           GENERAL

10.1        Begić d.o.o.  and the Hotel accept a number of credit cards as listed at the reception desk. All such credit cards are accepted in accordance with the regulations of the credit card company concerned.

10.2        These Guest Terms are governed by the laws of Croatia and each party irrevocably agrees that the courts of Croatia shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

11. NOTE

By written confirmation of the reservation of accommodation, the guest or group of guests, natural or legal person, who made the reservation, fully accepts these Terms.

This Privacy Statement applies to www.pansionbegic.com owned and operated by Pansion Begic. This Privacy Statement describes how we collect and use the information, which may include personal data, you provide on our web site: www.pansionbegic.com. It also describes the choices available to you regarding our use of your personal data and how you can access and update this data.

Data Collection

The types of personal data that we collect include:

  • Your first name, last name, email address, phone number and home address;
  • Credit card details (type of card, credit card number, name on card, expiration date and security code);
  • Guest stay data, including date of arrival and departure, special requests made, observations about your service preferences (including room preferences, facilities or any other services used);
  • Data you provide regarding your marketing preferences or in the course of participating in surveys, contests or promotional offers;

You may always choose what personal data (if any) you wish to provide to us. If you choose not to provide certain details, however, some of your transactions with us may be impacted.

Data we collect automatically

When using our website, we also collect information automatically, some of which may be personal data. This includes data such as language settings, IP address, location, device settings, device OS, log information, time of usage, URL requested, status report, user agent (information about the browser version), operating system, result (viewer or booker), browsing history, user ID, and type of data viewed. Processing Purposes

We use your personal data for the following purposes:

  • A. Reservations: We use your personal data to complete and administer your online reservation.
  • B. Customer service: We use your personal data to provide customer service.
  • C. Guest reviews: We may use your contact data to invite you by email to write a guest review after your stay. This can help other travellers to choose the accommodation that suits them best. If you submit a guest review, your review may be published on our website.
  • D. Marketing activities: We also use your data for marketing activities, as permitted by law. Where we use your personal data for direct marketing purposes, such as commercial newsletters and marketing communications on new products and services or other offers which we think may be of interest to you, we include an unsubscribe link that you can use if you do not want us to send messages in the future.
  • E. Other communications: There may be other times when we get in touch by email, by post, by phone or by texting you, depending on the contact data you share with us. There could be a number of reasons for this:
    • a. We may need to respond to and handle requests you have made.
      b. If you have not finalised a reservation online, we may email you a reminder to continue with your reservation. We believe that this additional service is useful to you because it allows you to carry on with a reservation without having to search for the accommodation again or fill in all the reservation details from scratch.
      c. When you use our services, we may send you a questionnaire or invite you to provide a review about your experience with our website. We believe that this additional service is useful to you and to us as we will be able to improve our website based on your feedback.
  • F. Analytics, improvements and research: We use personal data to conduct research and analysis. We may involve a third party to do this on our behalf. We may share or disclose the results of such research, including to third-parties, in anonymous, aggregated form. We use your personal data for analytical purposes, to improve our services, to enhance the user experience, and to improve the functionality and quality of our online travel services.
  • G. Security, fraud detection and prevention: We use the information, which may include personal data, in order to prevent fraud and other illegal or infringing activities. We also use this information to investigate and detect fraud. We can use personal data for risk assessment and security purposes, including the authentication of users. For these purposes, personal data may be shared with third parties, such as law enforcement authorities as permitted by applicable law and external advisors.
  • H. Legal and compliance: In certain cases, we need to use the information provided, which may include personal data, to handle and resolve legal disputes or complaints, for regulatory investigations and compliance, or to enforce agreement(s) or to comply with lawful requests from law enforcement insofar as it is required by law.
  • If we use automated means to process personal data which produces legal effects or significantly affects you, we will implement suitable measures to safeguard your rights and freedoms, including the right to obtain human intervention.

Legal Bases

  • In view of purposes A and B we rely on the performance of a contract: The use of your data may be necessary to perform the contract that you have with us. For example, if you use our services to make an online reservation, we will use your data to carry out our obligation to complete and administer that reservation under the contract that we have with you.
  • In view of purposes C-H, we rely on its legitimate interests: We use your data for our legitimate interests, such as providing you with the best appropriate content for the website, emails and newsletters, to improve and promote our products and services and the content on our website, and for administrative, fraud detection and legal purposes. When using personal data to serve our legitimate interests, we will always balance your rights and interests in the protection of your information against our rights and interests.
  • In respect of purpose H, we also rely, where applicable, on our obligation to comply with applicable law.
  • Where needed under applicable law, we will obtain your consent prior to processing your personal data for direct marketing purposes.

If needed in accordance with applicable law, we will ask your consent. You can withdraw your consent anytime by contacting us at any of the addresses at the end of this Privacy Statement.

Data Sharing

  • Third-party service providers: We use service providers to process your personal data strictly on our behalf. This processing would be for purposes as included in this Privacy Statement such as facilitating reservation payments, sending out marketing material or for analytical support services. These service providers are bound by confidentiality clauses and are not allowed to use your personal data for their own purposes or any other purpose.
  • Competent authorities: We disclose personal data to law enforcement and other governmental authorities insofar as it is required by law or is strictly necessary for the prevention, detection or prosecution of criminal acts and fraud.

International Data Transfers

The transmission of personal data as described in this Privacy Statement may include overseas transfers of personal data to countries whose data protection laws are not as comprehensive as those of the countries within the European Union. Where required by European law, we shall only transfer personal data to recipients offering an adequate level of data protection. In these situations, we make contractual arrangements to ensure that your personal data is still protected in line with European standards. Security

Pansion Begic observes reasonable procedures to prevent unauthorised access to, and the misuse of, information including personal data. We use appropriate business systems and procedures to protect and safeguard information including personal data. We also use security procedures and technical and physical restrictions for accessing and using the personal data on our servers. Only authorised personnel are permitted to access personal data in the course of their work.

Data Retention

We will retain your information, which may include personal data for as long as we deem it necessary to provide services to you, comply with applicable laws, resolve disputes with any parties and otherwise as necessary to allow us to conduct our business including to detect and prevent fraud or other illegal activities. All personal data we retain will be subject to this Privacy Statement. Your choices and rights

We want you to be in control of how your personal data is used by us. You can do this in the following ways:

  • You can ask us for a copy of the personal data we hold about you;
  • you can inform us of any changes to your personal data, or you can ask us to correct any of the personal data we hold about you;
  • in certain situations, you can ask us to erase or block or restrict the processing of the personal data we hold about you, or object to particular ways in which we are using your personal data; and
  • in certain situations, you can also ask us to send the personal data you have given us to a third party.

Where we are using your personal data on the basis of your consent, you are entitled to withdraw that consent at any time subject to applicable law. Moreover, where we process your personal data based on legitimate interest or the public interest, you have the right to object at any time to that use of your personal data subject to applicable law.
